Good, Fair Business
Copyright and Licensing The artist/s and/ or Tiger International Arts retain ownership of the copyright upon the creation of the commissioned work (Copyright Designs and Patents Act 1988, Copyright Law of the People's Republic of China 19/02/2002 ). Ownership of copyright will be transfered to commissioner/s and/or clients upon payment in full of the fee specified on the order form. Any attempt to reproduce the artwork without such payment, will be regarded as a breach of copyright.
The copy right granted is exclusively granted to the named client specified on the order form. The artist retains the right to use the artwork for self-promotion (only in portfolios and related compilations). The client is responsible for the clearing of any copyright or reference material supplied by the client and shall indemnify the artist and Tiger International Arts against any claims arising from materials thus provided.
Art Delivery
The artist can only adhere to deadlines agreed if there is no delay in the approval of rough drafts or in the supply of reference material. The artist/s and/or Tiger International Arts shall not be held responsible for any consequential loss arising from the late delivery of artwork. .
Client Cancellation
If the commission is cancelled the fees detailed in the order confirmation form will be payable: 25% of the agreed fee if cancelled by the client after delivery of rough drafts. 100% of the agreed fee if cancelled by the client on delivery of the finished artwork.
Client Rejection
If the artwork is rejected by the client the fees detailed in the order confirmation form will be payable: 20% if rejected after delivery of rough drafts. If a rough has not been requested prior to artwork, then 50% of the agreed fee if rejected on completion. If the artwork is rejected by the client upon completion, after the acceptance and approval of rough drafts, 60% of the agreed fee.
Artist Cancellation If the commission is cancelled by the artist and/or Tiger International Arts the commissioner and/or client will not be liable for the payment of the fees detailed in the order confirmation form. The artist and/or Tiger International Arts shall not be held responsible for any loss arising in consequence of the artistic cancellation.
Artist Rejection
If for any reason a commission is rejected by the artist and/or Tiger International Arts the commissioner and/ or client will not be liable for the payment of the fees detailed in the order confirmation form. The artist and/or Tiger International Arts shall not be held responsible for any loss arising in consequence of the artistic rejection.
If the artist has correctly followed the brief, and the work is consistent with that of the artist's portfolio, and with that shown to the client, then the full fee is payable. Under no circumstances can there be a reduction in the agreed fee if the client uses the artwork for the purposes detailed on the job acceptance form. Any objections to the final artwork must be conveyed within seven days of delivery, after which it shall be conclusively presumed that the artwork has been accepted. In the event of rejection of the artwork, all rights in the artwork shall remain the property of the artist.
Estimates
If an estimate is requested prior to receiving full details of the commission, it should be understood that this is in no way binding and may differ after the artist has received the complete brief.
Credit Terms
Payment shall be made within thirty days from the date of invoice. Payment not received within that time will be subject to an interest charge of 2.5% per month. These terms and conditions are governed by the laws of The United States of American and The People's Republic of China and may not be varied unless agreed by both parties in writing.
